A special form of marriage contract is the separation or divorce settlement agreement. These are concluded when it is highly probable that the spouses wish to divorce. A separation or divorce settlement agreement usually enables a simplified divorce procedure, the divorce by mutual consent. For this purpose, additional provisions are made in a divorce settlement agreement, for example on child maintenance or on the division of property or household effects.
In particular, however, we can also advise Sue in cases involving foreign countries: here, special regulations or other legal systems may apply. In detail, questions of private international law arise. For example, if the spouses both have the same nationality, the law of their concurrent nationality applies to their marriage, the marriage contract and a divorce, even if they live in another country (cf. in detail Art. 13 ff. EGBGB). There may also be particularities if the spouses live abroad and the divorce of the marriage is applied for abroad. Here, too, we offer the best possible solution.
